These terms and conditions govern the sale of Branco by Forlar products through the website www.brancobyforlar.com offered by Ar de Paixão, Lda with NIF 509097359 and headquarters at Rua Padre Cruz n.º 58, 4765-383 Oliveira São Mateus - Portugal.

 

Product availability

All product orders are subject to availability. In the event that there are difficulties in supplying products within the stipulated period, we will inform you of their unavailability and present information about potential replacement products.

At that time, the customer will have the possibility to:

  • choose to order the replacement products,
  • proceed with the purchase only for the available products
  • cancel the order.

The refund of any amount paid in excess will be made as soon as possible, using the same payment method.


Shipments to countries outside the European Union

1. Taxes and Customs Duties
Orders shipped to countries outside the European Union (non-EU markets) may be subject to taxes, customs duties, local Value Added Tax (VAT) or other import charges applicable in the destination country.

Payment of these charges is the sole responsibility of the customer/recipient and is not included in the total amount paid at the time of ordering on our website. Branco by Forlar has no control over these policies and cannot predict their value. We recommend that the customer contact the local customs or tax authorities in the destination country before making a purchase to enquire about additional costs.

2. VAT Exemption at Source
For orders destined for countries outside the EU, Branco by Forlar applies the Portuguese VAT exemption, as provided for in current legislation. The final invoiced amount will be automatically adjusted in the shopping basket as soon as you enter a non-EU delivery address.

3. Customs Clearance and Delays
All international orders are subject to a customs inspection and clearance process in the destination country. Branco by Forlar accepts no liability for any delivery delays caused by customs clearance procedures carried out by local authorities.

It is the customer’s responsibility to provide all necessary information (such as a local tax identification number or documentation) required by customs for the release of the parcel. Should the customer refuse to pay import duties or fail to cooperate with customs clearance, resulting in the order being returned to Branco by Forlar, the costs of outward and return shipping, as well as any return charges, will be deducted from any applicable refund.

4. Shipping Restrictions and Documentation
All shipments outside the EU will be accompanied by an invoice and customs declaration, detailing the contents and total value of the items, in accordance with international requirements.

 

Shipping costs

The customer must indicate an address where the order can be delivered within the normal working period or select one of the suggested collection points.

The shipping cost is calculated depending on the total weight of the order and the shipping location. To find out the cost, add the products you want to the cart. On the checkout page, after filling in your address, you will be given the shipping cost and the estimated delivery time.

 

Delivery

  1. After confirming the availability of the items and payment details, the customer will receive an order confirmation.
  2. After dispatch of the order, the customer will receive confirmation of shipment.
  3. BRANCO BY FORLAR is not responsible for delivery errors when these are due to inaccuracies in filling out the delivery form or the customer's non-presence at the indicated location. In the event of non-delivery, you may be charged the costs relating to new delivery attempts.


 

Return policy

  1. The customer may return the purchased products within a period of 20 days from receipt of the order shipping confirmation email . For this, they must not have been used or washed and the accompanying labels must not have been cut.
  2. BRANCO BY FORLAR reserves the right to refuse returns after the stipulated period or if the products are not in the same conditions in which they were sent.
  3. Free shipping or discounts associated with minimum order values presuppose that the minimum amount of eligibility is maintained after exercising the right of withdrawal. If the actual purchase value, after returns, does not reach this amount, the discount granted will be revoked and the amount due for the products kept will be recalculated, based on their regular price.
  4. The costs associated with the collection / reshipment will be borne by BRANCO BY FORLAR in cases of return due to non-compliance with the product. In case of return due to withdrawal, the associated costs will be charged to the customer.

    Options and cost associated with collection / return:


    Items should be returned to the following address: BRANCO by Forlar, Rua João de Castro 29, 4835-299 Selho de São Jorge, Portugal.
    Alternatively, home collection can be requested (only available in mainland Portugal). The home collection service is available upon request for an additional fee.

  5. The refund will be processed upon receipt of the item and confirmation that it meets the conditions described above. Refunds will be made using the same payment method used to process the order.
  6. If you wish to return the purchased products, you must contact BRANCO BY FORLAR ( branco@forlar.pt ). The body of the message must include:

    the order number
    Specify reason (include photos if relevant)




 

Law, applicable jurisdiction and disputes

The purchase of products through this website are regulated by Portuguese law. Any dispute is subject to the non-exclusive jurisdiction of the Portuguese courts. In the event of a dispute, the consumer may resort to the Consumer Dispute Arbitration Center of Vale do Ave (Rua Alfredo Guimarães 1, 4800-019 Guimarães - www.triave.pt ).
